Competition Commission of India ordered enquiry against IREL on our petition

Previously Most of the Beach Mineral Players established sophisticated factory for value addition. Due to the Government order all the private players are stopped in India. Now only IREL alone operate the Beach Minerals.  They make double price for the same product and their price and sale conditions also  vary from party to party. This will make Indian Titanium Producers and other value added producers to face huge loss. So many times, representations were given to Government as well as IREL through various channels. But no action.  So we filed a petition before the Competition Commission.

 

After hearing both sides, the Competition Commission pass a detailed order for conduct investigation against IREL by the Director General. Copy of order is given below.

Before taking action, our members should be heard – Madras High Court order

As usual, on the instigation of International competitors, the hooligans from India induced Bureaucracy to prepare Ex-party report against our members.  We submit representation to the concerned persons. Since no reply from them, we filed writ petition before the Madras High Court. The Honourable Madras High Court while disposing the writ petition make it clear that, the Principles of Natural Justice to be followed in this case also and in case Government want to take action based on the report, our members should be heard about the same.

Writ petition Seeking CBI Enquiry against Mr.S.Vaikundarajan filed by illegal mining Don Dayadevadas was dismissed by the Honourable High Court on 01.10.2015

Illegal mining Don Dayadevadas, due to business motive, filed a writ petition in the Madras High Court of Judicature at Madurai Bench. Dayadevadas made allegation that Mr. Vaikundarajan obtained environmental clearance by giving bribe to the authorities and seek CBI enquiry against Mr.S.Vaikundarajan. 

Mr.S.Vaikundrajan in his counter bring to the notice to the Honourable High Court that Dayadevadas is a business rival and he tried to become the Vice President of CAPEXIL which was protested by VV Mineral.

VV Mineral, as well as Dayadevadas both paid the prescribed fees to the Govt., and obtained Environmental Clearance and no bribe is paid. The CBI also made it clear that no offence is made out, there is no merit in the complaint of Mr.Dayadevadas. Hence the Honourable High Court dismissed the writ petition No. W.P. 16924 of 2012 dated 1.10.2015. High Court order copy is given below.

Stoppage of mining operation by the State Govt., is illegal and without any power

The State Government issued two Government orders vide G.O.Ms. No.156 Industries Department dated 08.08.2013  and G.O.Ms.No. 173, Industries Department dated 17.09.2013 to stop the mining operation of all private beach mineral mining leases until the inspection is completed by Mr. Gagandeep Singh Bedi, IAS. VV Mineral and Transworld filed writ petition before the Honourable High Court to struck down the stoppage portion of the G.O.s and to change the inspection officer instead of Mr. Gagandeep Singh Bedi, since Mr. Bedi has personal enemity with VV Mineral, when he was working as Sub Collector of Cheranmahadevi.

After hearing Government side and peruse the records, the Honourable High Court struck down the portion of the G.O. which insist the stoppage of mining operation as no powers has been vested with the State Government to stop the beach mineral mining operations when the lease is valid.

The Honourable High Court further appointed one Retd. High Court Judge instead of Mr. Gagandeep Singh Bedi,IAS.

Mr. Dayadevdas – Managing Partner of Southern Enterprises

 

M/S. Southern Enterprises and Indian Garnet Sand Company both belongs to Mining Don Dayadevadas. Ex.Central Minister Dhanukodi Athithan was associated with this company. This gentleman make lot of complaints against law obeying companies through Retd. Officers and through a Binamy federation called “Federation of Indian Placer Mineral Industries” and divert the government attention through other companies and there by carryout large scale illegal mining of rare beach minerals for a tune of 3.9 million M.Tons.

 

The Tamilnadu government captured the same and report to the Honourable High court. The Honourable High Court its order in W.P. 175/2010 directed the State government to take action against the culprits in accordance with law. Against the above said order, they have filed review petition before the Honourable High Court, as review application No. 61/2011 in WPMD No. 175/2010. The above said Review application was also dismissed by the Honourable Madras High Court division bench on  12.12.2013 .

 

Against the order of the Madras High Court division bench, they have SLP before the Supreme Court with condone delay petition. The Honourable Supreme court dismissed the on 02.02.2015 . Copy of the Supreme Court order attached.

Garnet Scam looting of Rare mineral by Federation of Indian Placer Mineral Industries President Mr.Dayadevadas owned companies – High Court dismiss the review petition filed by him

Madras High Court Madurai Bench directed the Government of Tamilnadu to take action in accordance with law based on Government report dated 14.11.2011 in which the Government reported that the companies owned by Dayadevadas involved large scale illegal mining and violation of environmental laws.

The President of Indian Placer Mineral Industry Mr.Dayadevadas who is the Managing Director and Managing Partner of Indian Garnet Sand Company and Southern Enterprises against which the Government pointed out serious violations filed a review petition before the Madras High Court, Madurai Bench to review its earlier Judgment dated 18.11.2011. The division bench of Madras High Court dismiss the review petition filed by the Minor on 12.12.2013. Un earthed Illegal Mining scam – Review petition filed before the High Court to review its earlier order

Madras High Court Madurai Bench direct the State Government of Tamilnadu to pass order in accordance with law based on its report dated 14.11.2011 regarding large scale violations and illegal mining and storing of 3.9 Million M.Ton Rare Mineral Sand.

Mega Rare Mineral Mining Scam by Dayadevadas – High Court direct State Govt., to pass order in accordance with law
